The process of collecting debts can be split into 4 stages

Letter Before Action

Before issuing any legal proceedings, a letter before action should be sent to a debtor.

Legal Issue of County Court Claim

If you send a letter before action to your debtor but do not receive a satisfactory response then the next stage is to issue legal proceedings through the County Court. You will send the debtor a court form requiring them to pay the debt, plus interest and costs within 14 days.

Enforcement of judgment if not paid

Once a CCJ has been obtained, it is then possible to try and “enforce” the Judgment to recover the debt immediately. The CCJ will include court costs and interest, if below £600 an option would be county court bailiff. Debts of over £600 can be transferred to the High Court for enforcement by the HC Enforcement officer, this is the most effective way of enforcement as they have more power than the Court County Bailiff for commercial debts.

County Court Judgment obtained

A CCJ is a court order that confirms that the debtor/company has defaulted on payment. A CCJ can be obtained immediately after the expiry date of the if no payment is received. Once a CCJ is obtained if payment is not made by the due date on the order then you have the power to commence enforcement action to try and collect the debt.

Corporate debt recovery is the process of pursuing payments of debts owed by Companies and sole trader businesses.

An email or letter from a company such as LPL is a cost-effective route for Credit Controllers and Business Owners and Managers to take control and speed up payment of overdue accounts.

The majority of collection agencies charge a percentage of the total amount owed if paid after the letter or telephone contact.

If payment is not received in response to the letter we can pass the matter to our legal team for legal action or you can issue your own legal action via money claims online.

Should an account be disputed then we can advise you on the likelyhood of recovery, and if we would recommend you proceed to legal action. We give you advice on how to deal with the situation and offer a mediation service to try and come to a settlement agreement on disputed matters which is sometimes a better outcome than going down the legal route and having costly solicitor fees, that are not recoverable even if you are successful if your account is less than £ 10K.

For large accounts over £5k then a different process such as a Statutory Demand and Winding Up/ Bankruptcy Proceedings may be an option, and this will be discussed with you. We do offer a Statutory Demand letter for debts over £ 5K and we can follow this through with the Statutory
